Flammable Clothing and Flammable Fabrics

Cause Burn Injury

Clothes that may ignite or are flammable are the source of serious burns, burn injuries, and death.

Federal Anti-Flammability Regulations

Clothing that has been designed, manufactured, and sold to the general public must meet the minimum safety standards set forth in the Flammable Fabrics Act (15 U.S.C. §§ 1191-1204). The federal regulations (Code of Federal Regulations) implementing the FFA are at16 C.F.R. § 1608.

Unfortunately, many clothing products have been recalled because they do not comply with the FFA standards. Nowadays, with the huge number of imported clothes, the safety risks posed to our families is rising. See, for example, the recent article in USA Today: New Zealand Investigates Chinese Clothing Imports.

Serious Burn Injury

Burns, of course, are among the most catastrophic and painful injuries anyone can endure. Immediate and costly medical attention, including long hospitalization and rehabilitation, may be required. Surgeries, including skin grafts, artificial skin products, rehabilitation to try and keep scarring minimal and the affected area flexible, may be required. Secondary infections are common, and can be deadly. Counseling and therapies on how to cope with everyday life, as well as a future as a burn victim, must be considered.

If clothing ignites or catches fire because the garment has high flammability, then serious burn injury or death may occur. While some agencies, such as the Consumer Product Safety Commission, may investigate the tragedy, they are generally powerless to offer the family any help aside from issuing a recall of the flammable product.

Flammable Clothing Liability

To help recover money to pay for the extensive financial impacts – aside from the physical, mental, and social destruction such injuries wreak on their victims -- that burn injuries can cause, a lawsuit can be filed against the responsible parties involved:

  • Manufacturer or assembler of the final clothing product;
  • The retailer of the dangerous product;
  • The suppliers of components or parts of the garment.
In a civil action to recover money damages for burn injuries suffered as a result of high flammability of clothing, the injured victim must prove several elements of the claim, including:
  • The clothing was defective and unreasonably dangerous because it was highly or unusually flammable;
  • The defect in the clothing caused the victim's injuries;
  • The defendant sold the clothing or the fabric from which the clothing was made or some other constituent of the clothing;
  • The defect in the clothing, fabric or other part of the garment existed at the time of the sale by the manufacturer, distributor or seller.

There are many types of clothing that have been the subject of burn injuries, including:

  • Children’s Pajamas
  • Fleece garments, including sweatshirts, shirts, vests, pants, robes, scarves
  • Throw blankets or quilted blankets
  • Children’s Halloween costumes

Retailers here some items have recalled for not complying with the FFA are the most popular chains, including, among others:

  • Gap
  • Old Navy
  • Kmart
  • Target
