Common Carrier
Negligence
A "common carrier" is a mode of transportation which conveys many people at one
time. Some examples of common carriers are the following:

A common carrier has a higher duty of care than an ordinary person who driving
people in this or her personal vehicle and does not get paid a fee for transporting people. In a
common carrier accident, the personal injury victim is generally not required prove the ordinary
negligence standard; rather, a common carrier accident victim is only required to prove slight
negligence.
For example, in a bus accident, the accident injury victim must prove that the bus
company, which owes the higher duty of care, must only prove the bus operator was
slightly negligent in causing the injury. The same example can be applied to a plane
crash, helicopter accident, train accident, or elevator accident, as well as other instances in
which the negligent party is deemed a common carrier.
