Misclassified Employee
When your employer classifies you
in an employment category, position, or title not entitled to overtime, although the substance of
your work is covered by the FLSA overtime rights, then you as an employee have been “misclassified”
as “exempt.” Being “exempt” means that you are not eligible for FLSA overtime and related
protections.
In order to be exempt from the
FLSA overtime pay requirements, an employee has to (1) receive a salary, and (2)
perform exempt duties. Exempt duties generally include (a) Executive, (2)
Administrative, or (c) Professional. There are, of course, variations and exceptions in these
classifications.
