Crashworthiness
Automobiles and other passenger
vehicles, including light trucks, sports utility vehicles (SUV), and minivans, must be
properly designed and manufactured to protect all occupants against great harm in an
accident. This principle is known as “crashworthiness.”
In an automobile crashworthiness
case, which is a type of products liability lawsuit, the cause of the accident is usually of minor
importance. While the auto manufacturer may try to paint the entire case as one about the
cause of the accident, such as driver fatigue, driver inattention, driver distraction, or driver
failing to evade a hazard, ultimately the trial's focus is on the vehicle defect which lead to
the extreme harms and losses in the traffic crash.
A crashworthiness lawsuit focuses on the injuries caused to the vehicle's passengers and driver due
to a defective design of the vehicle.
For example:
-
Did the injured driver
or passenger of the uncrashworthy vehicle come into contact with the interior of the
passenger compartment
-
Was the car’s
exterior is pushed inward crushing the occupants
-
Did a fire or an
explosion from the fuel system erupt, causing severe burn injury or
death
maims or kills the occupants, the
focus is on the vehicle’s design, or in other words, the motor vehicle’s ability to withstand a
crash or collision with driver and passenger safety intact.
Rollover
Accident
An automobile manufacturer may
produce and sell a vehicle that is defective because it fails to restrain occupants safely, or the
design is flawed because the vehicle’s driver or passenger compartments lack favorable
surfaces.
Other times, a vehicle is
manufactured with a faulty or poorly designed or operating fuel tank or fuel system, creating the
ultimate fire hazard. The car may have been designed, manufactured, and sold without
sufficient strength in its structure, or the steel cage the surrounds the passengers and driver,
which is prone to failing when involved in a crash.
Here's a list of motor vehicle manufacturers which sell, or recently sold, autos in the United
States:
Personal injury and wrongful death
cases involving vehicle crashworthiness are complex. Prompt investigation and product
preservation are key to moving the crashworthiness claim forward.
If you or a loved one has been
severely injured, burned, or killed as the result of an unsafe or poorly designed and manufactured
automobile, sports utility vehicle (SUV), or light truck, then contact a personal injury
attorney and trial lawyer in our firm to evaluate your restraint system failure claim, promptly and
in confidence.
In vehicle defect claims or auto
product liability claims, we may co-counsel, or jointly prosecute your serious
personal injury claim or wrongful death claim with a crashworthiness lawyer whom we know and
trust.
