Defective Machinery
Lawyers
Industrial machinery, found in Southwest Florida at sugar cane processing
plants, orange juice processors, auto repair shops, and other skilled machine shops, is
generally made up of moving parts such as reciprocating arms, rotating members, moving belts,
cutting teeth and meshing gears. Any contact with moving machine parts can be very dangerous
to workers.
Roughly 8 out of 10 industrial accident fatalities is the result of mechanical equipment.
Machinery accidents area leading cause of death and injury in the workplace.
Many of the injuries were caused by defective machinery or equipment that was designed or
manufactured without being properly guarded. Other common causes of machinery accidents
include:
- Machine is poorly designed or lacks safety features such as a guard or shield to protect
workers from moving parts
- Machine emits toxic fumes or chemicals without a proper shield to prevent leaks or
splashes
- Machine lacks emergency shut-off in the event of an accident or malfunction
- Machine's maintenance schedule has not been followed (usually in an attempt to save
costs)
- Poorly considered operational systems
Machinery accidents are some of the most destructive to the human body, including:
- Crush injury
- Disfigurement
- Amputation or loss of limb
- Burn injury
- Head injury
- Brain injury
- Internal injury
- Blindness
- Death
Product Liability Claim Outside Workers Comp
Because a machinery accident often occurs in a place of work, the injured worker may receive
workers compensation, which is very limited in Florida. If the manufacturer, supplier, or
installer of the equipment involved in the accident is liable under product liability, then you are
permitted to file a product liability lawsuit against the machinery manufacturer directly, outside
of workers compensation.
Defective product claims can be complex, and should be trusted to a personal injury lawyer who
has experience handling product liability claims. Attorney David
Hughes Harris of our firm has that experience.
